Conditions of Use


Please take a moment to read these terms and conditions – they affect how your order will be handled. We have tried to present them to you in a way that is easy to understand and in plain English.
There are a few things you should remember before ordering:
We do the best we can to show and describe the items as accurately as possible. However good we are at this, nothing beats going to your local dive store and buying from them. You will get to see the item, try the item and ask the store for advice.
Much of the equipment we sell can be dangerous if used incorrectly. Whether you are buying for someone else, a snorkeler or a diver, the person using the equipment must be properly trained.
If you are unhappy with any aspect of the service you have received, please contact us using the information shown in the Contact link on the website. Your satisfaction with our service is the most important aspect of what we do – please do tell us if things go wrong.
General Terms
These terms and conditions tell you how we, DIVE Northampton, sell things to you using our websites. These terms and conditions cover all goods purchased from us. Your online order and payment details also contain information that affects your order. The terms and conditions that applied at the time and the additional information you provided when placing your order will decide how your order is handled. You will be asked to confirm that you accept these terms and conditions before completing your purchase.
Your Order
We can only sell you something if we have it. Whilst we do all we can to keep our websites up to date, popular items will sometimes become unavailable. All items are therefore subject to availability. If you have ordered an item that is unavailable, we will contact you and tell you how long it will be before we can send you your item. We may also offer you an alternative. If we do this and you decide to accept an alternative item, you do so entirely at your own risk.
When you place an order, we are not forced to accept it. There are many reasons why we may decide not to accept an order and you will be told, usually by email, when your order has been accepted.
You must be aged 18 or over to buy things from the websites. We may ask you to send us proof of your age before we can accept your order.
Whilst we do all we can to make sure that the information on our site is correct, things sometimes go wrong: prices may be out of date, images and photographs are not always accurate and size or colour information may be wrong. When we discover an error or are told about a problem we will put it right without any liability.
How we get your item to you
Within the UK, we will send all itemsby Courier, by First Class Signed For Recorded Delivery or ParcelForce 48 and a proof of dispatch obtained. For all items, a signature will be required and this should be remembered when assiging a delivery address. Unless otherwise stated in the item decsription, shipping is charged at a flat rate of £6.50 for all items up to 20kg unless they are going to Northern Ireland - £10 or the Highlands and Islands - £15.
Delivery times may very and you should allow a maximum of 21 days from the time we told you that your item had been sent out. If your item(s) arrive in a poor condition or are missing, you must tell us within 3 days. We will contact the carrier and do what we can to fix the problem. This may include sending out a replacement, making a partial refund or refunding your payment in full. Any refund will only be made after the carrier has completed their investigation.
We will send your item to the delivery address given when you order. If you don’t give us a delivery address then your purchase will be sent to the billing address. Once an item has been sent out, a fee of £12.50 must be paid for an item to be re-directed to an alternative address and this will be done only after the item has reached a depot or been returned to us.
If you are paying by PayPal, the item must be delivered to the address stated on the PayPal payment email. This address must be a PayPal 'Confimred / Validated' address within the UK.
How to Pay
If you are paying by PayPal, your item will be dispatched once your PayPal payment has cleared. Your payment must come from a verified PayPal account and the item(s) will only be shipped to a verified address linked to that account. The account must belong to the purchaser. In the event that your item is unavailable, we will refund your PayPal payment accordingly unless you decide to wait for the item to become available or accept an alternative item. All payments must be in GB Pounds Sterling. Payment by Cash or Credit/Debit Card is available if you are collecting your item(s).
You may cancel your order at any time before payment has been taken and your order has been dispatched. To cancel, you must contact us by email on or telephone on 01604 586156.
Returning your item(s)
For faulty goods or defects, please read the appropriate section in Liability & Warranties. If you purchased the wrong size, you can return the item to us, at your own expense, and we will exchange it for the correct size. You will need to pay a further shipping charge to us for sending the item to you again. The item must be unused, still have it's original packaging and in a condition that would allow it to be resold as new.
If the correct size is unavailable, we will refund the original cost of the item less a 20% handling charge.
Sending Abroad
As a general rule, we will not ship abroad. If you wish to send a special request for us to do so, please send us an email to or telephone on 01604 586156.
Personal Data
DIVE Northampton will not pass on any of your information to any other company without your prior consent. The information we hold about you will be stored on our Web Host’s Secure Servers and our computers and your details will be automatically added to our mailing list. If you want us to remove you from our mailing list, simply reply accordingly to any email received or notify us by email with your name and customer number. Liability & Warranties
All items are supplied with a full UK warranty from the manufacturer or supplier, the details of which are usually provided with your goods and are also available on request. For UK purchasers, any warranty issue should be referred to us. For non-UK purchasers, all warranty claims should be addressed to the relevant manufacturer directly.
If on delivery there is a defect in any of the goods then we will ask you to contact us by telephone or email and tell us what is wrong. We will then usually ask you to return the goods to us for inspection. You will pay the cost of returning the item to us. The goods must be returned to us in its original packaging. If we are satisfied that the defect or fault has not occurred as a result of miss-use and the goods are unused, we will repair or replace the defective goods free of charge. If the item cannot be repaired you may choose not to have a replacement. In this instance, you are entitled to a full refund of the price of the product (or a proportion of the price). Your statutory rights are unaffected.
If the goods have been used, you will need to contact us, the manufacturer or supplier in accordance with the guarantee / warranty provided with the goods when they were purchased as mentioned above. We do not accept, and hereby exclude to the fullest extent permissible under law, any liability for indirect or consequential loss or damage including, but not limited to, any loss of data, profit, revenue or business however caused. Nothing in these terms and conditions shall be construed as excluding or limiting liability for death or personal injury caused by negligence or for fraud.
Legal Bits
You are not entitled to assign or transfer any of your rights or obligations under these terms and conditions. If we are unable to fulfil our obligation due to circumstances beyond our reasonable control, we shall not be liable for any failure to perform any obligation under these terms and conditions. If any provision or any part of any provision in these terms and conditions is held by to be illegal, invalid, void or unenforceable for any reason then that provision, or part provision, shall be treated as having been deleted. The remainder of these terms and conditions shall continue to apply. Failure by us to enforce any obligation under these terms and conditions shall not be deemed to constitute any waiver of that obligation. The laws of England shall govern these terms and conditions and you agree to submit to the non-exclusive jurisdiction of the English courts.
