Please take a moment to read these terms and conditions – they affect how your order will be handled. We have tried to present them to you in a way that is easy to understand and in plain English.

There are a few things you should remember before ordering:

We do the best we can to show and describe the items as accurately as possible. However good we are at this, nothing beats going to your local dive store and buying from them. You will get to see the item, try the item and ask the store for advice.

Much of the equipment we sell can be dangerous if used incorrectly. Whether you are buying for someone else, a snorkeler or a diver, the person using the equipment must be properly trained.

If you are unhappy with any aspect of the service you have received, please contact us using the information shown in the Contact us link on the website. Your satisfaction with our service is the most important aspect of what we do – please do tell us if things go wrong so we can try to put them right.

 

General Terms

These terms and conditions tell you how we, DIVE Northampton, sell things to you using our websites. These terms and conditions cover all goods purchased from us. Your online order and payment details also contain information that affects your order. The terms and conditions that applied at the time and the additional information you provided when placing your order will decide how your order is handled. You will be asked to confirm that you accept these terms and conditions before completing your purchase.

 

Your Order

We can only sell you something if we have it. Whilst we do all we can to keep our websites up to date, popular items will sometimes become unavailable. All items are therefore subject to availability. If you have ordered an item that is unavailable, we will contact you and tell you how long it will be before we can send you your item. We may also offer you an alternative. If we do this and you decide to accept an alternative item, you do so entirely at your own risk.

When you place an order, we are not forced to accept it. There are many reasons why we may decide not to accept an order and you will be told, usually by email, when your order has been accepted.

You must be aged 18 or over to buy things from the websites. We may ask you to send us proof of your age before we can accept your order.

Whilst we do all we can to make sure that the information on our site is correct, things sometimes go wrong: prices may be out of date, images and photographs are not always accurate and size or colour information may be wrong. When we discover an error or are told about a problem we will put it right without any liability.

 

How we get your item to you and how to return an item

Within the UK there are sorts of regulations that govern the distance selling of items, in particular through a website. For full information about our Shipping and Returns policy, please go to the Shipping & Returns page of the website.

 

How to Pay

If you are paying by PayPal, your item will be dispatched once your PayPal payment has cleared. Your payment must come from a verified PayPal account and the item(s) will only be shipped to a verified address linked to that account. The account must belong to the purchaser. In the event that your item is unavailable, we will refund your PayPal payment accordingly unless you decide to wait for the item to become available or accept an alternative item. All payments must be in GB Pounds Sterling. Payment by Cash or Credit/Debit Card is available if you are collecting your item(s).

You may cancel your order at any time before payment has been taken and your order has been dispatched. To cancel, you must contact us by email on sales@divenorthampton.co.uk, telephone on 01604 586156 or through the Contact us link on the website.

 

Sending Abroad

As a general rule, we will not ship abroad other than to Ireland, the Isle of Man and the Channel Islands. Personal Data

Within the UK there are sorts of regulations that govern the retention and use of personal data, not least the new GDPR regulations. For full information about our Privacy and Personal Data Policy, please go to the Privacy Notice page of the website.

 

Liability & Warranties

All items are supplied with a full UK warranty from the manufacturer or supplier, the details of which are usually provided with your goods and are also available on request or through the manufacturer's website. For UK purchasers, any warranty issue should be referred to us. For non-UK purchasers, all warranty claims should be addressed to the relevant manufacturer directly.

Should the item appear to be faulty or not as described, you may return the item for a replacement or refund within 30 days following the date you received your item. We would however ask you to contact us within the 30 day period so that we can ensure that your return is processed correctly. The item must be returned complete, undamaged, in all the original packaging and in a resaleable condition if appropriate. You must indicate whether you want a refund or replacement. A refund will only be made once the item has been received here at DIVE Northampton so you must ensure that an appropriate method of return is chosen and we strongly recommend that the item is fully insured when being returned. We will not be able to issue an refund or replacement for any item lost or damaged when being returned to us. For complex issues, we may have to ask the Manufacturer to look into the issue and this may take a few working days to complete.

Should the item appear to be faulty, you may return the item for a repair, replacement or possibly a proportional refund within 12 months following the date you received your item. We would however ask you to contact us within the 12 month period so that we can ensure that your return is processed correctly. The item must be returned complete and undamaged other than the fault reported. A replacement or repair will only be made once the item has been received here at DIVE Northampton so you must ensure that an appropriate method of return is chosen and we strongly recommend that the item is fully insured when being returned. We will not be able to issue a refund or replacement for any item lost or damaged when being returned to us. Your item will have to be returned to the Manufacturer to look into the issue and assess the best way forward. We will keep you informed of progress but some manufacturers are based outside of the UK and turnaround times may be extended.

Should the item appear to be faulty and the Manufacturer has offered an extended Warranty beyond the usual 12 month period, you may return the item for a replacement or repair within the agreed extended warranty period following the date you received your item. We would however ask you to contact us within this period so that we can ensure that your return is processed correctly. The item must be returned complete and undamaged other than the fault reported. A replacement or repair will only be made once the item has been received here at DIVE Northampton so you must ensure that an appropriate method of return is chosen and we strongly recommend that the item is fully insured when being returned. We will not be able to issue a refund or replacement for any item lost or damaged when being returned to us. Your item will have to be returned to the Manufacturer to look into the issue and assess the best way forward. We will keep you informed of progress but some manufacturers are based outside of the UK and turnaround times may be extended. You will be liable for all shipping and handling fees associated with this process.

We do not accept, and hereby exclude to the fullest extent permissible under law, any liability for indirect or consequential loss or damage including, but not limited to, any loss of data, profit, revenue or business however caused. Nothing in these terms and conditions shall be construed as excluding or limiting liability for death or personal injury caused by negligence or for fraud.

 

Legal Bits

You are not entitled to assign or transfer any of your rights or obligations under these terms and conditions. If we are unable to fulfil our obligation due to circumstances beyond our reasonable control, we shall not be liable for any failure to perform any obligation under these terms and conditions. If any provision or any part of any provision in these terms and conditions is held by to be illegal, invalid, void or unenforceable for any reason then that provision, or part provision, shall be treated as having been deleted. The remainder of these terms and conditions shall continue to apply. Failure by us to enforce any obligation under these terms and conditions shall not be deemed to constitute any waiver of that obligation. The laws of England shall govern these terms and conditions and you agree to submit to the non-exclusive jurisdiction of the English courts.
